Work Permits and Visas in the United Kingdom for Non-UK Expats
Until recently, citizens of European Economic Area (EEA) countries, along with Swiss nationals, could travel freely to and from the UK, and work there with minimal restrictions. All that changed beginning in 2020, when the United Kingdom officially withdrew from the European Union and reasserted its sovereignty.
Beginning July 1, 2021, new requirements for establishing right-to-work (RTW) will be strictly enforced for EEA/Swiss employees, with the onus of proof placed squarely on the shoulders of employers. Irish citizens with a valid passport are granted the continued right to work in the UK without additional documentation.
Right to Work for EEA/Swiss Citizens
Beginning July 1, 2021, EU, EEA and Swiss citizens will need more than just a passport or national identity card to prove their right to work in the UK. Employers will be required to check their right to work online, using a share code and the employee’s date of birth, or by checking the employee’s original documents. Employees can obtain a share code from the UK government’s online immigration service.
EEA/EU/Swiss workers have the right to work in the UK if:
- The worker can provide proof of settled or pre-settled status under the EU Settlement Scheme
- They have a Frontier Worker permit
- They have a biometric residence permit or card
- They have submitted an application to the EU Settlement Scheme
- They have been granted indefinite permission to enter or remain in the UK
- They have a visa to work or study in the UK
Right to Work for employees from other countries
To qualify for the right to work in the UK, non EEA employees must be invited by an employer who is a licensed sponsor, and must provide an Immigration Employment Document (IED) confirming their right to work in the UK. Examples of IEDs include UK work permits and specific types of visas. The most common type of visa for expat employees is a Skilled Worker visa.
To qualify for a Skilled Worker visa, employees must:
- Work for an approved UK employer
- Provide a certificate of sponsorship from the employer describing the role the worker will play within the company
- Perform a job that is listed among eligible occupations
- Earn a minimum salary based on the type of work position
- Be able to speak, read and write English
A Skilled Worker visa is good for up to five years, after which it can be extended an indefinite number of times.
Documentation needed for a Skilled Worker visa includes:
- Certificate of sponsorship reference number
- Proof of English language proficiency
- Valid passport
- Job title, occupation code, and annual salary
- Employer name and sponsor license number
Other types of eligible visas include:
- Spouse visas
- Dependent visas
- UK ancestry visas
- Working holidaymaker visas

Special COVID Travel Restrictions
While the UK lifted most of its COVID-19 lockdown restrictions on July 19, 2021, travel restrictions remain in place for the time being. Which you should consider in your turn as a global employer. Most countries are on the UK’s amber list, and travelers from those countries are required to quarantine for 10 days upon arrival in the UK, and be subjected to a PCR test prior to arrival, and two additional tests on days two and eight after arrival. Travelers from the UK’s red list are required to quarantine in government-mandated hotels. Visitors from green list countries can travel freely without quarantine.
